Summary
Lee County's fence rules govern where a fence goes rather than who pays for it. No fence may sit in a street right-of-way or easement, or within five feet of the mean high-water line of a natural water body, and corner visibility must stay clear.
No fence or wall, excluding seawalls, may be erected, placed or maintained: (1) Within any street right-of-way or street easement... (3) Closer than five feet to the mean high-water line along natural water bodies... except that, where the canal is seawalled, the fence may be built landward of the seawall.

Full Breakdown
Section 34-1744(a) bars any fence or wall, seawalls excluded, from a street right-of-way or street easement, from closer to the Gulf of Mexico than Chapter 6, Article III allows, and from closer than five feet to the mean high-water line along natural water bodies, including canals created from sovereign lands; where the canal is seawalled the fence may be built landward of the seawall. Section 34-1746 adds that nothing in the fence division permits construction inside a public or private easement that prohibits it. Section 34-1742(e) requires the finished side to face the adjoining lot, and Section 34-3131 keeps a 25-foot corner visibility triangle clear.
Violations & Fines
A fence in a right-of-way or a prohibited easement is a code violation the county can order corrected, with Hearing Examiner fines of $25 to $1,000 per day for a first violation.
