Jackson County, MO Fence Regulations: Fence Permit Requirements (2026)

Jackson County's building code, Chapter 54, sets one bright-line test for fence permits in the unincorporated county: height. Section 5409.4.a.2 lists "Fences not over 6 feet (1829 mm) high" among the work exempted from permitting, alongside items like tool sheds under 200 square feet and decks under 36 inches. Anything taller than 6 feet falls outside that exemption and needs a permit before the fence goes up. The exemption is narrow: Section 5409.4 warns that being excused from a permit "shall not be deemed to grant authorization for any work to be done in any manner in violation of any provision of this chapter or any other laws or ordinances of Jackson County," so an over-height fence still has to meet the placement, sight-triangle, electric and barbed-wire limits found elsewhere in the code.

To get a permit, Section 5401.10 requires a written application to the building official describing the work, the property by legal description or address, and the estimated valuation, along with any required plans. Under Section 5401.13 the permit becomes invalid if work has not started within 180 days of issuance, or if work is later suspended for 180 days, though the building official can grant a written extension for justifiable cause. Permit fees are charged under the valuation-based schedule in Section 5410.1, with a plan review fee added when applicable. The building official may reject an incomplete application in writing or, under Section 5401.14, suspend or revoke a permit issued on inaccurate information.
