Summary
In unincorporated Hillsborough County, a fence needs no zoning or building permit under LDC § 6.07.01.C, but a wall does: walls require a building permit and must meet the Florida Building Code. Either way, the owner is responsible for keeping the structure entirely on their own property and meeting the Code's fence standards.
A. Purpose The purpose of these provisions is to prescribe standards for fences and walls for the conservation and protection of property, the assurance of safety and security, the enhancement of privacy and the improvement of the visual environment including the provision of a neat appearance in keeping with neighborhood character. Hedges are regulated in Part 6.06.00 of this Code.
B. Definition As used in this Section, unless otherwise specified, the term "fence" shall be used to include fences and walls.
C. Wall Permit Required Fences do not require zoning permits or a building permit. The property owner is responsible for the location of the fence wholly on their property and for compliance with the provisions of this Section. Walls require a building permit and are subject to the provisions of the Florida Building Code.
Full Breakdown
Section 6.07.01 of the Land Development Code, Generally, opens Part 6.07.00's fence and wall standards by stating their purpose: protecting property, ensuring safety and security, enhancing privacy and keeping a neat appearance consistent with neighborhood character (hedges are regulated separately, under Part 6.06.00). Subsection B fixes the vocabulary for the whole Part: unless a provision says otherwise, 'fence' means both fences and walls, so every height, material and setback rule that follows in § 6.07.02 applies equally to a masonry wall and a wood or chain-link fence.
Subsection C, captioned Wall Permit Required, draws the actual permitting line: fences do not require a zoning permit or a building permit at all. What a property owner does need is compliance, not paperwork; they remain responsible for siting the fence entirely within their own property line and for meeting every standard set out in the rest of the Section, including the height limits, prohibited materials and visibility-triangle rules in § 6.07.02. Walls are different: they require a building permit and must comply with the Florida Building Code, the same review track as any other permanent structure.
That means a homeowner installing a standard four-foot chain-link or six-foot wood privacy fence can build without going to county permitting at all, while a homeowner or developer building a masonry or concrete wall, including the walls up to six or eight feet permitted around multifamily and commercial buffer areas under § 6.07.02.B, must first pull a building permit and pass Florida Building Code review before construction.
Violations & Fines
Because fences carry no permit, the county's exposure is siting and standards compliance, not paperwork; an owner who locates a fence off their property line or in violation of § 6.07.02's height, material or visibility-triangle rules is subject to Code Enforcement action under LDC § 11.06.01. Building an unpermitted wall, or one that fails Florida Building Code review, is a violation the Hillsborough County Code Enforcement Board can pursue under F.S. § 162.01 et seq., with citation authority resting with the County Administrator.
