Under LDC Section 210, opaque fences taller than eight feet require a building permit obtained pursuant to a Level 1 Review. Section 210.B further requires an appropriate building permit for precast masonry, concrete, or brick fence units of uniform length and size. Fences must not sit in the right-of-way, obstruct emergency access, or impede drainage. Accessory structures generally require permits under Section 209, but a routine wood or chain-link fence at or below eight feet does not. Apply through the Polk County Building Division.
Building or exceeding height limits without the required permit is a code-enforcement violation; Polk County Code Enforcement may issue citations and pursue fines and liens under Florida Statutes Chapter 162.
