Texas counties cannot adopt a general building code or require permits for ordinary structures the way cities do, and they have no zoning authority. The Planning Department administers subdivision platting under Local Government Code Chapters 232 and 233, plus floodplain and septic permitting, none of which is a fence permit. Approval can still be needed: inside a city you need that city's fence permit; an association's covenants may require architectural approval; and floodplain work may need a county floodplain development permit. Along a public county road, a commissioners court may establish set-back lines under Chapter 233, so confirm none applies.
There is no county fence-permit violation in unincorporated areas because no such permit exists. Building without a required city permit is enforced by that city. Ignoring HOA architectural approval is a private civil matter enforced under the covenants.
