Most fences in unincorporated Sutter County need no building permit: the Zoning Code exempts fences up to 7 feet, while fences between 7 and 9 feet in agricultural and commercial districts require building permit approval. The Sutter County Zoning Code development standards (Sections 1500-05-040 and 1500-07-040) state that walls and fences outside front or street side yard setbacks may reach a maximum height of 7 feet exempt from building permit approval, or 9 feet subject to building permit approval. Building permits are issued by the Sutter County Building Division under Chapter 1300 of the County Code, which adopts the 2022 California Building Code and 2022 California Residential Code (Sections 1300-050 and 1300-100, Ordinance No. 1704 of February 14, 2023) and applies to all unincorporated territory enforced by the County Building Official (Section 1300-150). In the Estate Residential (ER) and Ranchette (RAN) districts, open ornamental fences over 3 feet 6 inches in the front setback require Zoning Clearance approval from the Planning Division, may not conflict with rights-of-way or utility easements, and may require an engineering sight-distance analysis at the applicant's expense. Retaining walls and fences combined with retaining structures are reviewed by the Building Division under the adopted state codes.
Building a fence over 7 feet without a building permit, or an ER/RAN ornamental front fence without Zoning Clearance, is unlawful. Under Section 1300-160 each day of violation of the building codes is a separate offense punishable under Chapter 87 of the County Code, and under Sections 1500-26-040 through 1500-26-060 of the Zoning Code the county may abate the fence as a public nuisance, prosecute a misdemeanor or infraction, or assess administrative penalties.
