California Health and Safety Code section 115922 (Swimming Pool Safety Act) applies to any building permit issued for construction of a new pool or spa, or remodel of an existing pool or spa, at a private single-family home. The owner must install at least two of the seven listed safety features. The most common is an isolation enclosure separating the pool from the home that is at least 60 inches in height; has a maximum vertical clearance from the ground to the bottom of the enclosure of 2 inches; has no gaps or voids through which a sphere of 4 inches in diameter can pass; and has gates that are self-closing with self-latching devices with release mechanisms placed no lower than 54 inches above the ground. Other options include ASTM-compliant removable mesh fencing, approved pool covers, exit alarms on doors providing direct access from the home to the pool, self-closing/self-latching devices on those doors, and pool alarms meeting ASTM F2208. Two features must operate independently. Lincoln Building enforces this at final inspection before approval.
Failing to install required pool barriers blocks final inspection sign-off and pool occupancy under Cal. Health and Safety Code section 115922.5. The Building Division will withhold the certificate of completion. Drowning incidents can also create severe civil liability for the property owner.
