All swimming pools deeper than 24 inches and all hot tubs and spas must be enclosed by a fence at least 4 feet tall with openings no larger than 4 inches, per the Building Services 'Fences' guide implementing LMC 15.05.100 and the adopted 2021 International Codes. Gates must have a latch meeting the adopted code, or, for hot tubs/spas, a lockable safety cover meeting the 150-pound load standard may substitute.
The Longmont Fence Building Guide (Revised 4/24/19, summarizing LMC 15.05.100) requires that all swimming pools with a depth greater than 24 inches and all hot tubs and spas be enclosed by fencing 'of a type that is not readily accessible by children and that contains no opening larger than four inches.' Fencing must be at least 4 feet in height and, if equipped with a gate, the gate must have a latch meeting the City's adopted codes (2021 IBC/IRC). In lieu of fencing, a spa or hot tub may have a lockable cover capable of supporting at least 150 pounds, locked when the spa or hot tub is not in use. Any fence built as a pool barrier must also comply with all general fence rules (height limits, sight triangles, permit). Because Longmont adopted the 2021 I-Codes effective Jan. 1, 2022, the IRC Appendix V / IBC Section 3109 swimming-pool provisions also apply: 48-inch minimum barrier on the outside face, openings less than 4 inches, self-closing and self-latching gates that open outward, latch release at least 54 inches high (or on the pool side at least 3 inches below the top), and door alarms on dwelling doors that open directly to the pool area.
A pool or spa cannot be filled and used (and will fail final inspection) until a compliant barrier is installed. Removing or disabling a barrier or gate latch is a code violation and creates serious child-drowning liability. Building Services can require correction, charge re-inspection fees, and refer the matter to code enforcement.
