Davie, FL Fire Regulations: Backyard Fires (2026)

Davie does not have its own backyard-fire ordinance, so the controlling rules come from Broward County's open-burning program. Broward County Code of Ordinances Chapter 27, Article IX (section 27-286) permits open burning conducted solely for recreational purposes, for ceremonial occasions, or for outdoor noncommercial preparation of food, provided that excessive smoke and a nuisance are not created and approval is obtained from the appropriate fire authority. This is the legal basis for a backyard campfire, chiminea, or recreational fire pit in Davie. The same section prohibits burning yard trash and household paper products generated on occupied residential premises, so a backyard fire cannot double as a waste-disposal fire. Broward County references a 300-foot setback from occupied buildings for open burning unless a waiver is obtained, which is rarely achievable on small residential lots - so practical residential fires need to stay small, contained, and smoke-controlled to avoid a nuisance. Burn only clean, dry firewood (never trash, leaves, or treated wood), keep the fire attended at all times, keep water or an extinguisher close, and never burn during high winds or drought-related advisories. Davie's Fire & Life Safety Division enforces the Florida Fire Prevention Code, which prohibits fires that create a hazard.
