Clearwater requires property owners to keep lots free of overgrown vegetation and accumulated combustible debris, with weeds and grass capped at 12 inches and accumulations enforced as public nuisances under the Community Development Code.
Division 15 of Article 3 of the Clearwater Community Development Code governs property maintenance and public nuisances. Excessive growth of weeds, grass, undergrowth, or similar plant material reaching more than 12 inches in height is prohibited, as is accumulation of debris or yard trash. Owners must also maintain abutting rights-of-way so vegetation or trash does not extend over sidewalks or pavement by more than four inches. Dead trees, fallen limbs, and combustible debris must be removed. The Fire Marshal can order abatement of vegetation that creates a fire hazard near structures, and Code Compliance can issue notices of violation directing owners to mow, trim, or clear within a specified period.
Failure to abate after notice triggers escalating fines through the Municipal Code Enforcement Board and the city may clear the property and lien the costs.
