Florida Statute Sec. 877.20 allows counties and cities to enact juvenile curfew ordinances by reference, and Clearwater applies the state framework through its public offenses chapter. Under Florida Statute Sec. 877.22, a minor under 16 may not be in a public place or business establishment between 11:00 p.m. and 5:00 a.m. Sunday through Thursday, and between 12:01 a.m. and 6:00 a.m. on Saturday and Sunday and legal holidays. Suspended or expelled minors are also prohibited from public places within 1,000 feet of a school between 9:00 a.m. and 2:00 p.m. on school days. Exceptions include minors accompanied by a parent, traveling to or from work, or responding to an emergency.
First offense produces a written warning. A second violation is a civil infraction with a $50 fine. Officers may transport the minor to a curfew facility and notify a parent within two hours.
