Clearwater Community Development Code Section 3-1407 prohibits commercial vehicles from residential rights-of-way and limits oversized commercial vehicles in residential setbacks based on chassis dimensions.
Under CDC Sec. 3-1407, any commercial vehicle is prohibited from parking or storage on any public right-of-way in a residential zoning district or on a right-of-way contiguous to residentially zoned property. Additionally, commercial vehicles measuring more than 20 feet in total chassis and body length, more than seven feet in total width, or more than seven feet in total height are subject to additional setback restrictions. The intent is to preserve attractive residential areas and promote safe, unimpeded traffic circulation. Service calls and active loading or unloading by tradespeople are typically treated as temporary uses and not violations.
Notices of violation are issued by code compliance; persistent violations result in daily fines and special magistrate proceedings until the vehicle is removed.
