Summary

Beyond the 100-foot structure clearance, Section 8.09.070(D)(6)-(7) requires anyone who owns, leases or maintains a parcel to keep ladder fuels cleared at least ten feet beyond the edge of every driveway and road on improved or unimproved land when the Investigative Official flags a fire-hazard condition.

These county ordinances apply to unincorporated areas of El Dorado County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

6.Clearance Along Driveways. The responsible person shall at all times maintain clearance along all driveways to be necessary for the safe ingress and egress of emergency vehicles. If the current condition of fuels along the driveway of the parcel, improved or unimproved, is determined by the Investigative Official to be a fire hazard which must be treated or abated, the responsible person shall comply with the following:a.All ladder fuels shall be cleared to a minimum width of a ten-foot wide strip of land beyond the edge of the driveway. Additional clearance width beyond ten feet may be required by the Enforcement Official when documented information is provided by the Investigative Official that the clearance is necessary to significantly reduce the risk of transmission of flame or heat that can obstruct the driveway.

Full Breakdown

070(D) of the Hazardous Vegetation and Defensible Space Ordinance goes past the basic structure-adjacent defensible space rule to impose access-route clearance duties. Under paragraph 6, 'Clearance Along Driveways,' the responsible person must maintain clearance along every driveway needed for safe emergency-vehicle ingress and egress; once the Investigative Official determines the fuel condition along a driveway is a fire hazard, ladder fuels must be cleared to a minimum ten-foot-wide strip beyond the driveway's edge, and the Enforcement Official can require more than ten feet if documented information shows it's necessary to cut the risk of flame or heat obstructing the driveway.

Paragraph 7, 'Clearance Along Roads,' imposes the identical ten-foot ladder-fuel clearance standard on improved and unimproved parcels adjacent to roads the Enforcement Official designates as needed for emergency access, again with authority to expand the clearance width on documented findings. Both duties apply regardless of whether the parcel is improved or vacant, and both are triggered by an official hazard determination rather than applying automatically to every driveway or road frontage in the County. This clearance duty sits alongside, but is distinct from, the county's 100-foot building-perimeter defensible space and the vertical limbing standard for roadside vegetation.

Violations & Fines

Failure to maintain the required ten-foot ladder-fuel clearance is enforced through Chapter 8.09's administrative process: a notice of violation and order to correct under Section 8.09.116, an appeal right under Section 8.09.120, and an infraction penalty under Section 8.09.125, with the County able to summarily abate the hazard and bill the property owner for the cost under Sections 8.09.150 and 8.09.170 if the condition isn't corrected.
