SLO County Code Title 16, Chapter 16.04 (Burning Limitations) makes it unlawful, in the county outside of incorporated cities and towns, to build any outdoor fire 'for the purpose of burning papers, leaves, trash or other inflammable material whether in an incinerator or in small piles between the hours of nine a.m. of any one day and five a.m. of the following day, or within thirty feet of any building or structure or land covered with grass, brush, stubble, grain, hay or other inflammable material, or to leave such fire burning or unextinguished without some person in attendance.' CAL FIRE/SLO County Fire treats backyard recreational fires as requiring a permit during burn season and limits them to commercially built, non-combustible containers no larger than 3 feet in diameter and 2 feet tall, with a spark arrester screen (openings no greater than 1/4 inch), 10 feet of cleared ground around the device, and a charged garden hose on hand.
Burning outside of the lawful window or without a required attendant is a violation of Title 16 enforceable as an infraction or misdemeanor; CAL FIRE may also revoke any related burn permit and bill cost-recovery for any escaped fire.
