Full Breakdown

Under § 569-40(B)(2) of the Sanitary Code, campfires and fires used solely for recreational purposes are permissible open burning when a nuisance is not created. The law specifically excludes burning of leaves, lawn and garden debris from this recreational-fire exception, and directs residents to check with local fire marshals and chiefs for additional restrictions.

Violations & Fines

A campfire or fire pit that creates a nuisance -- smoke, odor or safety hazard affecting neighbors -- loses the recreational exception and becomes unlawful open burning under § 569-40, subject to a civil penalty up to $1,000.
