Fire pit rules in Kern County, CA — also called outdoor burning, recreational fire, or open flame ordinances — cover fuel types, clearances, and when burning is allowed.
Recreational fires (backyard fire pits, chimineas, portable outdoor fireplaces) in unincorporated Kern County are governed by California Fire Code Section 307 as adopted in Kern County Code Chapter 17.32, which imposes setbacks, size limits, and on-site control requirements.
Kern County Code Chapter 17.32 adopts the California Fire Code by reference, including CFC § 307 governing 'Open Burning, Recreational Fires and Portable Outdoor Fireplaces.' Under CFC § 307.4.2, recreational fires must not be conducted within 25 feet of a structure or combustible material, and the fire's fuel area is limited to a 3-foot diameter and 2-foot height. Portable outdoor fireplaces (commercial fire-pit appliances and chimineas) must be used in accordance with manufacturer instructions and kept at least 15 feet from a structure or combustible material per CFC § 307.4.3. CFC § 307.5 requires that any open or recreational fire be constantly attended by a competent person until extinguished, and that a portable fire extinguisher, water hose, or other approved means of extinguishment be available. Recreational fires using only seasoned firewood for cooking, warmth, or social purposes do not require a burn permit, but the Kern County Fire Department retains authority under CFC § 307.1.1 to prohibit any open or recreational fire when atmospheric or local conditions make it hazardous. Within designated Wildland-Urban Interface communities and during Red Flag warning days, the Fire Chief may suspend recreational fires entirely.
Violations of CFC § 307 as adopted are enforced as Fire Code violations under Kern County Code § 17.32. KCFD may order immediate extinguishment, issue an administrative citation, and—if the fire escapes—pursue civil cost recovery and criminal charges under CA Health & Safety Code §§ 13007 and 13009.
