Consumer fireworks in unincorporated Palm Beach County are governed by Florida Statute Β§791.08, which preempts local bans on three designated holidays: July 4, December 31, and January 1. Outside those days, only sparklers and novelties on the FL approved list are legal.
FL FS Β§791.08, enacted by HB 1059 (2020), expressly authorizes consumer fireworks discharge on Independence Day, New Year's Eve, and New Year's Day, and prohibits any county or city from regulating or banning fireworks on those dates. PBC has no further restrictive ordinance on use during the holidays. On all other days, only items meeting the FL Β§791.01(4) sparkler list (snakes, smoke devices, fountains, and certain sparklers) may be used. Aerial and explosive devices outside the three holidays are illegal under state law and treated as a first-degree misdemeanor punishable by up to one year in jail and 1,000 dollars in fines. PBCFR and PBSO enforce. Discharge is prohibited within Everglades Agricultural Area conservation lands and on county park property at all times. HOAs and condo associations may further restrict on private property.
