Florida's 2020 fireworks law (HB 1059, Fla. Stat. §791.08) lets residents use consumer fireworks on three designated holidays: New Year's Day, July 4, and New Year's Eve. On any other day, only sparklers and approved novelties are legal at retail. Bay County and its cities cannot prohibit holiday fireworks but may restrict discharge hours, use near beach dunes, and use around Tyndall Air Force Base. Big Gulf-front displays over Panama City Beach and St. Andrew Bay require a fire-marshal permit. During a drought burn ban, discharge near dry pine flatwoods is strongly discouraged.
Setting off consumer fireworks outside the three legal holidays is a second-degree misdemeanor: up to 60 days jail and a $500 fine. Careless use causing injury or fire escalates to felony charges.
