Under Florida law, consumer fireworks are legal to use on three days only: New Year's Day (Jan 1), Independence Day (July 4), and New Year's Eve (Dec 31). On other days only sparklers are permitted. Manatee County cannot ban fireworks on those three holidays.
Florida's 2020 fireworks law (FS 791.08) states the fireworks chapter does not prohibit use 'solely and exclusively during a designated holiday' — defined as Jan 1, July 4, and Dec 31. On any other date, Chapter 791 limits residents to approved sparklers and novelties. Local governments retain limited authority over the manner and time of use but cannot outlaw consumer fireworks on the three holidays. A county-declared drought burn ban is a separate matter and can suspend fireworks temporarily. Public displays require a permit from the county or municipality.
