Bexar County Commissioners Court has restricted certain fireworks in unincorporated areas under Texas Local Government Code Β§352.051 and Texas Occupations Code Chapter 2154. The current order prohibits 'skyrockets with sticks' and 'missiles with fins' due to drought conditions. Standing fire-marshal rules also bar fireworks within 600 feet of schools, churches, hospitals, and child-care facilities, and within 100 feet of flammable liquid/gas storage. Violations are Class C misdemeanors with fines up to $500. A countywide burn ban was extended through February 9, 2026.
Under Texas Local Government Code Β§352.051 the Commissioners Court may, on a finding by the Texas A&M Forest Service of drought conditions in the Keetch-Byram Drought Index, prohibit or restrict the sale and use of restricted fireworks (those classified as 'skyrockets with sticks' and 'missiles with fins' under 26 TAC Β§34.601). The Commissioners Court approved such an order in early December 2025 ahead of the New Year's Eve fireworks season; the order took effect before December 15, 2025 to satisfy state notice requirements. Independent of drought orders, the Bexar County Fire Marshal's standing fireworks order β codified in the Order Restricting Certain Fireworks in Unincorporated Areas of Bexar County β prohibits detonating fireworks within 600 feet of schools, churches, hospitals, and licensed child-care facilities without written authorization, within 100 feet of flammable liquid or gas storage, and from or into motor vehicles; it also requires a licensed pyrotechnic operator for any 1.3G public display (Texas Occupations Code Chapter 2154). A countywide burn ban β separate from the fireworks order β was in effect through February 9, 2026 due to ongoing drought. Inside city limits (e.g., San Antonio), city ordinance generally bans the sale, possession, and use of fireworks year-round; the county order applies only to unincorporated territory.
