In Lee County, Florida law lets you use consumer fireworks only on New Year's Day, July 4, and New Year's Eve. On any other day, using them is unlawful statewide. Local rules and HOA covenants may add limits, but cannot ban holiday use.
Florida's fireworks law is set at the state level (FS Ch. 791), so it applies the same in unincorporated Lee County and its cities. A 2020 amendment (FS 791.08) exempts the use of fireworks "solely and exclusively during a designated holiday" - defined as New Year's Day (Jan 1), Independence Day (July 4), and New Year's Eve (Dec 31). Outside those three dates, FS 791.02 makes it unlawful to use or explode fireworks. Sparklers and other novelties classified as "sparklers" under FS 791.01 remain legal year-round. Local governments may still regulate time, place, and manner; HOAs may keep covenant restrictions but cannot abrogate the holiday right.
Using fireworks outside a designated holiday is a first-degree misdemeanor under Ch. 791 (up to $1,000 fine and/or 1 year). Local law enforcement handles complaints.
