Under Florida law, consumer fireworks are legal in Sarasota County on New Year's Day, July 4, and New Year's Eve. On all other days, only sparklers and similar non-explosive novelties are permitted. The county cannot ban holiday use.
Since 2020, FS 791.08 exempts fireworks use from Chapter 791's prohibitions when used solely and exclusively during a designated holiday: January 1, July 4, and December 31. Outside those three dates, only 'sparklers' (defined by FS 791.01 as devices emitting sparks with no explosive compound, not detonating, and containing 100 grams or less of chemical compound) and other approved novelties may be used. Local governments and HOAs may restrict fireworks, but cannot eliminate a homeowner's right to use them on the three designated holidays. Aerial and explosive fireworks otherwise remain unlawful under FS 791.02.
Illegal fireworks use (outside designated holidays) is a first-degree misdemeanor under FS 791.02, punishable by up to one year in jail and a $1,000 fine.
