Florida law lets residents use consumer fireworks on just three days a year: New Year's Day, July 4, and New Year's Eve. On every other day only sparklers and novelties are legal. Seminole County cannot ban use on those three holidays.
Since 2020, FS 791.08 permits consumer fireworks (aerials, firecrackers) statewide when used solely and exclusively on January 1, July 4, or December 31. On all other dates, FS 791.02 makes it unlawful to use or explode fireworks; only listed sparklers and novelties (FS 791.01) are allowed. This is a state preemption, so Seminole County and its cities cannot prohibit holiday use, though HOA covenants recorded before the law may still restrict them. County burn bans do not override the fireworks holidays but do restrict open flames.
Illegal fireworks use outside the three holidays is a first-degree misdemeanor under FS 791.06, punishable by up to $1,000 fine and one year.
