Fireworks are prohibited on all Volusia County beaches year-round. Florida Senate Bill 140 regarding designated holiday use does not apply to county beaches. Within unincorporated residential areas, consumer fireworks are legal on July 4, NYE, and New Year's Day per FL HB 1059 (2020).
FL Statute Β§791 regulates fireworks. HB 1059 (2020) legalized consumer fireworks on designated holidays: July 4, December 31, and January 1. Previously, a widely used βagricultural useβ exemption served as a loophole. Cities cannot ban fireworks on designated holidays but can regulate discharge hours and locations. Sparklers and novelty items available year-round. Professional displays require fire marshal permits. During burn bans, additional restrictions may apply.
