Florida law lets residents use consumer fireworks only on New Year's Day, July 4, and New Year's Eve. Collier County cannot ban them on those three days. Sparklers stay legal year-round; HOA covenants may still restrict use.
FS 791.08 defines the three 'designated holidays'—January 1, July 4, and December 31—when consumer fireworks may be used, and bars local governments from prohibiting them then. On any other day, only sparklers and approved novelties from FS 791.02 are lawful without a display permit; larger aerials require a 15-day-advance public-display permit approved by the fire chief. The statute preserves HOA authority: recorded Chapter 720 covenants may still prohibit fireworks even on the holidays. Selling fireworks is also suspended during a Collier drought burn ban.
Illegal fireworks sale or use outside the three holidays is a violation of Chapter 791; enforced by law enforcement and fire officials, with fireworks sales barred during declared drought bans.
