791.08 Use during designated holidays; exemption.- (1) As used in this section, the term "designated holiday" means: (a) New Year's Day, January 1; (b) Independence Day, July 4; or (c) New Year's Eve, December 31. (2) This chapter does not prohibit the use of fireworks solely and exclusively during a designated holiday.

Section 12-89 applies the Lee County Fireworks and Sparklers Ordinance to the unincorporated areas and covers sale, storage and use, plus permitting for outdoor displays and pyrotechnics before a proximate audience. Section 12-91(a) prohibits using, exploding or storing fireworks unless you first obtain a county display permit, or the use is by a railroad or for quarrying, blasting or another industrial purpose under F.S. 791.04, or is a bona fide agricultural or fish hatchery use under F.S. 791.07. Retail sale requires a state-licensed seller and a permanent building. Only sparklers on the State Fire Marshal's approved list may be sold to the public.
