Texas has no general county zoning, so unincorporated Lubbock County cannot flatly ban fireworks. Occupations Code Chapter 2154 makes 1.4G consumer fireworks permissible statewide. Under Local Government Code 352.051, only when the Texas A&M Forest Service finds drought conditions (a Keetch-Byram Drought Index of 575 or greater) may the commissioners court, by order, prohibit or restrict the sale or use of 'restricted fireworks' (skyrockets and missiles with fins/sticks) in the unincorporated area for a limited period. Inside the City of Lubbock, Article 10.08 of the city code bans the sale, possession, and discharge of all fireworks year-round. Occ. Code 2154.251 also bars igniting fireworks within 600 feet of a church, hospital, school, or child-care center.
In the City of Lubbock, a fireworks violation is a misdemeanor punishable by a fine up to $1,000, and the fire marshal may seize the fireworks (city code art. 10.08).
