Nevada County is designated a 'no-fireworks' jurisdiction. Title 4 of the Nevada County Code, combined with state law, prohibits the sale, possession, transportation, storage, and discharge of any fireworks including those classified by the State Fire Marshal as 'Safe and Sane.' The prohibition applies year-round; it is not limited to fire season. Anyone who causes a fire by using illegal fireworks faces both criminal prosecution and full cost-recovery for suppression under Health & Safety Code 13009 and Public Resources Code 4421-4422. Civil penalties under Health & Safety Code 12677 can reach $5,000 per offense, and dangerous fireworks (M-80s, sky rockets, mortars) trigger felony exposure.
