Santa Rosa County, FL Fire Regulations: Fireworks (2026)

Florida Statute 791.08 (2020) lets residents use consumer fireworks solely on three designated holidays: January 1, July 4, and December 31. On those days the county and cities cannot prohibit use. Outside those dates, only state-approved sparklers, fountains, and novelties are legal without an agricultural exemption. The statute still allows local regulation of the manner and location of use (nuisance, discharge near structures, county burn-ban interaction). During a county burn ban, fireworks caution still applies. Homeowners associations may not bar holiday use. Milton, Gulf Breeze, and Jay follow the same statewide holiday rule.
