All aerial consumer fireworks and firecrackers are illegal throughout Rhode Island under RIGL 11-13-1. Only ground-based sparkling devices (sparklers, snaps, smoke devices) are legal. Professional displays require a State Fire Marshal permit filed at least 15 days in advance and must comply with NFPA 1123/1124. Fireworks are prohibited within 200 feet of churches, hospitals, nursing homes, and schools (RIGL 23-28.11). Municipalities may impose additional restrictions including banning sparklers.
Rhode Island law (RI Gen Laws Β§11-13) prohibits the sale, possession, and use of most consumer fireworks. Only sparklers, novelty items, and certain ground-based devices are permitted for personal use. Aerial fireworks, firecrackers, Roman candles, and bottle rockets are strictly prohibited. Only professionally licensed displays with RI State Fire Marshal permits are legal. The State Fire Marshal oversees all fireworks enforcement statewide. Purchasing fireworks in other states and bringing them to RI is also illegal.
Possession of illegal fireworks: fine up to $1,000 and/or imprisonment up to one year. Confiscation of all fireworks. Additional charges if injury occurs.
