Santa Maria is one of the few California cities where State Fire Marshal-approved 'Safe and Sane' fireworks are legal. Residents may discharge them only on July 4 between 11:00 a.m. and 11:00 p.m. All 'dangerous fireworks' (firecrackers, bottle rockets, mortars, M-80s, sky rockets) remain illegal year-round under California Health & Safety Code section 12505.
Santa Maria adopts California Fire Code (CFC) Chapter 56 (Explosives and Fireworks) by reference through Santa Maria Municipal Code Chapter 9-28 (Fire Prevention Code). Under California Health & Safety Code section 12529, 'safe and sane fireworks' are those approved by the U.S. Consumer Product Safety Commission and tested by the California State Fire Marshal. Santa Maria, Guadalupe, and Lompoc are the only jurisdictions in Santa Barbara County where Safe and Sane fireworks are legal. Sales are allowed only at temporary stands on commercial or industrial zoned property within the city limits, beginning at 12:00 noon on June 28 and ending at 11:00 p.m. on July 4. Consumer use is restricted to July 4 between 11:00 a.m. and 11:00 p.m. - use at any other time, even on July 3 or July 5, draws the same $1,000 fine as a dangerous-firework violation. The Santa Maria Fire Department uses high-altitude aircraft equipped with video and GPS to identify illegal-firework launch sites; the property owner or occupant at the identified address is cited regardless of who lit the device. Aerial fireworks displays require a permit application to the Fire Department at least 15 working days before the event.
An administrative citation of $1,000 is issued to the property owner or occupant of the address where illegal fireworks (or Safe and Sane fireworks used outside the legal hours) are detected. Possession of dangerous fireworks without a permit is also a misdemeanor under California Health & Safety Code section 12677. In 2024 the City issued 65 fireworks citations in a single Fourth-of-July week.
