Florida law makes it unlawful to use or explode true fireworks except sparklers and approved novelties, and as of 2020 allows consumer fireworks on New Year's Eve/Day and July 4. Under Fla. Stat. 791.02(1), it is unlawful to offer, sell, use, or explode any fireworks, except that the board of county commissioners may adopt rules for permitting supervised public displays by fair associations, amusement parks, and similar groups when the display takes place outside any municipality - which is the case throughout unincorporated Marion County. Each display must be handled by a competent operator approved by the fire chief after inspection, and applications must be filed at least 15 days in advance. 'Fireworks' is defined broadly in Fla. Stat. 791.01 to include firecrackers, skyrockets, roman candles, torpedoes, and similar items, but excludes division-approved sparklers and listed novelties. Separately, Fla. Stat. 791.08 (and 2020's s. 791.08) permits residents to use consumer fireworks on designated holidays - New Year's Eve, New Year's Day, and Independence Day. Marion County honors these state rules and may suspend all fireworks use during a declared burn ban.
Illegal sale, use, or explosion of non-exempt fireworks is a first-degree misdemeanor under Fla. Stat. 791.06, punishable by up to one year in jail and/or a $1,000 fine. Holding a public display without the required county-commission permit is also a violation.
