Consumer fireworks are regulated by Florida law (Fla. Stat. 791) and Venice Code Ch. 38. Aerial fireworks are only legal on July 4, December 31 and January 1; sparklers and ground-based novelty items remain legal year-round.
Fla. Stat. 791.08 was amended in 2020 to permit residential consumer fireworks on July 4, December 31 and January 1, overriding earlier 'agricultural use' loopholes. Venice has not adopted a stricter local ordinance, so the state schedule controls. Public fireworks displays - including the City's July 4 fireworks launched from North Brohard Beach - require a permit from the Venice Fire Department under Ch. 38 / NFPA 1160. Discharge on a beach or in a city park is prohibited under Ch. 46 (Parks and Recreation).
Illegal discharge outside permitted days or in parks/beaches is a misdemeanor and a Code offense under Sec. 1-14. Maximum fine: $500 per occurrence; state-law violations carry additional penalties up to a first-degree misdemeanor for unlawful sale.
