Consumer fireworks are broadly legal in unincorporated Brazoria County. Texas counties cannot flatly ban them; the commissioners court may only restrict certain "restricted fireworks" when drought conditions (Keetch-Byram Index 575+) are declared. Inside Pearland, all fireworks are prohibited.
Texas allows consumer fireworks statewide under Occupations Code Ch. 2154, and Brazoria County has no general power to prohibit them in the unincorporated area. Under Local Government Code §352.051 the commissioners court may, only upon a drought determination by the Texas A&M Forest Service (Keetch-Byram Drought Index of 575 or greater), issue an order restricting or prohibiting the sale or use of "restricted fireworks" (skyrockets with sticks and missiles with fins) in the unincorporated area. That order expires when the drought ends. Cities set their own rules: Pearland bans all fireworks in the city and its ETJ. Always check for an active drought order or burn ban before the season.
Violating a county drought/fireworks order or a city ban (e.g. Pearland) is a Class C misdemeanor punishable by a fine up to $2,000, plus confiscation of the fireworks.
