Florida requires working smoke alarms in all dwellings. Battery-powered alarms installed or replaced in one- and two-family homes and townhomes must use a sealed 10-year, nonremovable, nonreplaceable battery, per state statute enforced through the Florida Building Code.
FS 553.883 governs smoke alarms in one- and two-family dwellings and townhomes. Since January 1, 2015, any newly installed or replacement battery-powered smoke alarm 'must be powered by a nonremovable, nonreplaceable battery that powers the alarm for at least 10 years.' Homes undergoing repairs or a level 1 alteration may use these 10-year sealed-battery alarms instead of retrofitting to hardwired units. The Florida Fire Prevention Code (NFPA 72) sets placement—inside each sleeping room, outside each sleeping area, and on every level. Collier County enforces these standards through building permits and code enforcement; there is no stricter county-specific rule.
Missing or non-compliant smoke alarms can fail building inspection and, in rentals, expose landlords to code-enforcement action and liability under Florida law.
