Full Breakdown
County Code § 16.02.001 requires every owner of a residential building to install smoke-detecting devices that sense combustion particles and sound an audible alarm, and to keep them in working order at all times. New construction and permitted alterations must wire detectors into the building's power; existing buildings may run on building wiring or batteries, owner's choice. Owners must install and maintain the devices; tenants in rental units also must maintain any detector in their unit. Selling, leasing, or tampering with a required detector is a separate violation. This chapter does not spell out its own incorporated/unincorporated scope the way the Building Code does, so it defaults to unincorporated New Castle County; Wilmington and Newark enforce their own fire and building codes, not this chapter.
Violations & Fines
Unlawful to fail to install required detectors, to sell/convey/lease a unit lacking them, to tamper with or disable a detector, or to let one go unmaintained; general penalty under § 1.01.009 applies.
