Code § 15.2-922. Landlords must furnish tenants an annual certificate confirming the detectors work and must fix a malfunctioning unit within five days of written notice.

These county ordinances apply to unincorporated areas of Loudoun County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

In accordance with the authorities specified in Section 15.2-922 of the Code of Virginia, smoke detectors shall be installed in the following structures or buildings: (a) Any building containing one or more dwelling units, (b) Any hotel or motel ... and, (c) Rooming houses regularly used, offered for, or intended to be used to provide overnight sleeping accommodations. ... Smoke detectors installed pursuant to this section shall be installed in conformance with the provisions of the Uniform Statewide Building Code. Smoke detectors shall be either battery operated or AC powered units. The owner of any unit which is rented or leased, at the beginning of each tenancy and at least annually thereafter, shall furnish the tenant with a certificate that all required smoke detectors are present, have been inspected, and are in good working order. ... The owner of any unit which is rented or leased shall be obligated to service, repair or replace any malfunctioning smoke detectors within five days of receipt of written notice from the tenant that such smoke detector is in need of service, repair, or replacement.

Full Breakdown

07 of Loudoun County's Fire Prevention Code, adopted under the authority of Va. 2-922, requires smoke detectors in three categories of structures: any building containing one or more dwelling units, any hotel or motel offering overnight sleeping accommodations, and any rooming house used for overnight lodging. 01 sets the installation and maintenance standard: detectors must conform to the Virginia Uniform Statewide Building Code and be either battery-operated or AC-powered. For rented or leased units, the owner must give the tenant a written certificate, at the start of every tenancy and at least once a year after that, confirming all required smoke detectors are present, have been inspected, and are in good working order.

Day-to-day testing, repair, and maintenance inside a rented unit is the tenant's job, except in hallways, stairwells, and other common areas of multifamily buildings, which remain the owner's responsibility. If a tenant gives written notice that a detector is malfunctioning, the owner must service, repair, or replace it within five days. 02 makes clear this article does not excuse an owner from any other Uniform Statewide Building Code requirement found in Chapter 1410 of the County's ordinances. 06.

Violations & Fines

Failing to install required smoke detectors, or an owner's failure to provide the annual tenant certificate or repair a reported malfunction within five days, is a violation of the County's Fire Prevention Code. Under § 1602.05 that is a Class 1 misdemeanor, punishable as set out in Chapter 202.08(b) of the Codified Ordinances, with any appeal heard by the Building Code and Appeals Board.
