Summary

Chatham County's Property Maintenance Code requires every dwelling unit in the unincorporated county to have an approved, listed smoke detector meeting UL217. Detectors must sit outside every sleeping area, inside every bedroom, and on every story including basements. Split-level units without a door between floors need only one alarm upstairs. Violators face enforcement under Section 21-509.

These county ordinances apply to unincorporated areas of Chatham County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Smoke Detector Systems. Every dwelling unit shall be provided with an approved listed smoke detector installed in accordance with the manufacturer's recommendation and listing. When activated, the detector shall provide an audible alarm. The detector shall be tested in accordance with and meet the requirements of UL217 (1989), Single and Multiple Station Smoke Detectors. Smoke detector shall be installed at all of the following locations: i. On the ceiling or wall outside of each separate sleeping area in the immediate vicinity of bedrooms. ii. In each room used for sleeping purposes. iii. In each story within a dwelling unit, including basements and cellars but not including crawl spaces and uninhabitable attics. In dwellings or dwelling units with split levels and without an intervening door between the adjacent levels, a smoke alarm installed on the upper level shall suffice for the adjacent lower level provided that the lower level is less than on full story below the upper level.

Full Breakdown

Section 21-515(1)(h) of the Code of Chatham County, part of the Property Maintenance article amended March 25, 2011, sets the smoke-alarm floor for every dwelling unit in unincorporated Chatham County. The detector must be an approved, listed model installed per the manufacturer's instructions and must sound an audible alarm when triggered. The code names the testing standard directly: UL217 (1989), Single and Multiple Station Smoke Detectors. Placement isn't left to the owner's judgment. The section requires one detector on the ceiling or wall outside each separate sleeping area, one inside each room used for sleeping, and one on every story of the dwelling, including basements and cellars, but not crawl spaces or uninhabitable attics.

Split-level units get a narrow break: if there's no door between the levels and the lower floor sits less than a full story below the upper one, a single alarm on the upper level covers both. Enforcement runs through the Director of Inspections, the code official, under Section 21-509, which sets the penalty for any violation of the article at up to $500, up to 30 days in the county jail, or up to 60 days on the work gang, and treats each day the violation continues as a separate offense.

A dwelling missing required detectors can also be swept into the condemnation track under Sections 21-513 and 21-514 if the code official finds the unit unfit for habitation.

Violations & Fines

Missing or non-working detectors, wrong placement (none outside a sleeping area, no coverage on a story), or detectors that don't meet the UL217 listing standard violate Section 21-515(1)(h). The Director of Inspections cites the owner under Section 21-509: up to a $500 fine, up to 30 days in jail, or up to 60 days of work-gang labor per offense, with each day of noncompliance counted separately.

Frequently Asked Questions

Does Chatham County require a smoke detector in every bedroom?
Yes. Section 21-515(1)(h) requires a listed smoke detector in each room used for sleeping, plus one on the ceiling or wall just outside every separate sleeping area. Every story of the dwelling needs coverage too, including basements and cellars, though crawl spaces and uninhabitable attics are exempt.
What happens if my rental unit doesn't have a working smoke detector?
The Director of Inspections can cite the owner under Section 21-509 for violating the county's Property Maintenance Code. A conviction carries a fine up to $500, up to 30 days in the county jail, or up to 60 days on the work gang, and every day the detector stays missing counts as a new offense.
Do split-level homes need a detector on every level?
Not always. Section 21-515(1)(h) allows one alarm on the upper level to cover the level below it when there's no door separating the floors and the lower level sits less than a full story beneath the upper one. Otherwise every story needs its own detector.
