Montgomery County, MD Fire Regulations: Smoke Detectors (2026)

Montgomery County enforces smoke alarm requirements through the Maryland Building Performance Standards and the county fire prevention code as implemented by MCFRS. All dwellings must have smoke alarms on every level including the basement, inside each bedroom, and in the hallway outside sleeping areas. As of Maryland law updates, all replacement smoke alarms must be sealed lithium battery units with a 10-year lifespan or hardwired with battery backup. Ionization, photoelectric, or dual-sensor alarms are accepted. New construction and major renovations require interconnected hardwired smoke alarms so that activation of one triggers all alarms throughout the dwelling. Carbon monoxide detectors are also required outside sleeping areas in homes with fuel-burning appliances, attached garages, or fireplaces. The MCFRS Community Risk Reduction Division conducts free home smoke alarm installations for residents, particularly targeting senior citizens, low-income households, and older housing stock. Montgomery County has among the highest smoke alarm compliance rates in Maryland due to active enforcement and community outreach. Upon sale of a home, Maryland law requires a smoke alarm certificate confirming compliance.
