Sarasota County adopts the statewide Florida Building Code, so smoke-alarm rules are set at the state level. The Florida Building Code (Residential) R314 requires smoke alarms in each sleeping room, outside each separate sleeping area, and on each story of the dwelling, interconnected where required. FS 553.883 requires that a newly installed or replaced battery-powered smoke alarm be powered by a nonremovable, nonreplaceable battery lasting at least 10 years. For existing one- and two-family dwellings and townhomes undergoing repairs or a Level 1 alteration, 10-year sealed-battery alarms may be used in lieu of hardwiring. Landlords must maintain working smoke alarms in rental units.
Enforcement is through building permits, inspections, and code enforcement; noncompliant or missing alarms can block a certificate of occupancy and expose landlords to liability.
