Summary

New dwellings and structures in the EFC (Exclusive Forest and Conservation) District must meet strict forest structure siting and fire safety standards designed to minimize wildfire hazard; no variance or adjustment can reduce these dimensional standards, and noncompliant proposals fall to a discretionary Type II review.

These county ordinances apply to unincorporated areas of Washington County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

428-1 Intent and Purpose. The following siting standards apply to all new dwellings and structures in the EFC District. The purpose of the following standards is to ensure that structures are sited in a manner compatible with forest operations and agriculture, to minimize wildfire hazards and risks, and to conserve values found on forest lands. 428-2 Applicability. The forest structure siting and the fire safety standards of this section apply to all new dwellings and structures, including but not limited to replacement dwellings and accessory structures... A variance or adjustment request to reduce the dimensional standards of Section 428-3 shall not be permitted.

Full Breakdown

Community Development Code Section 428 applies forest structure siting and fire safety standards to all new dwellings and structures, including replacement dwellings and residential, agricultural and forestry accessory structures, sited in the county's EFC zoning district. Section 428-1 states the purpose plainly: siting structures compatibly with forest operations and agriculture, minimizing wildfire hazards and risks, and conserving forest land values. 1 sets concrete siting distances: part or all of a new dwelling must sit within 300 feet of the public road providing access, and where no other dwelling stands within 500 feet of a side, street-side or rear property line, the entire dwelling must be located at least 200 feet from that line, positioned nearest the side with fire protection services.

Dwellings must also sit at least 125 feet from a riparian corridor. A requires that dwellings be located on a parcel within a fire protection district, or covered by a contract for residential fire protection, before a Type I permit issues; the Oregon Department of Forestry does not count as a qualifying fire protection district. 2 further requires proof of an authorized domestic water source under Oregon Department of Water Resources rules. Critically, Section 428-2 bars any variance or adjustment to reduce these dimensional standards, and any dwelling or structure that cannot meet the Type I standards must instead go through a discretionary Type II procedure and satisfy the added standards of Section 428-4.

Violations & Fines

Because Section 428-2 forbids any variance to reduce the dimensional siting or fire-break standards, a project that cannot meet them must be reviewed and approved through a Type II procedure under Section 428-4 before a permit will issue. Under Section 215-2 the county will deny or condition a permit where an existing Code violation is on file, and violations are prosecuted under Chapter 1.14 of the Washington County Code per Section 215-3.

Frequently Asked Questions

What is the EFC District wildfire siting rule in Washington County?
Section 428 requires new dwellings and structures in the EFC (Exclusive Forest and Conservation) District to meet specific siting distances from roads, property lines and riparian corridors, be within a fire protection district or under a fire-protection contract, and use an approved water source, all aimed at minimizing wildfire risk on forest land.
Can I get a variance to build closer than the required setbacks?
No. Section 428-2 expressly states that a variance or adjustment request to reduce the dimensional standards of Section 428-3 is not permitted. A structure that cannot meet the Type I siting standards must instead go through a Type II discretionary review under Section 428-4.
Does my new forest-zone home need to be in a fire district?
Yes. Section 428-3.4.A requires the dwelling to sit on a parcel within a fire protection district, or be covered by a contract for residential fire protection; the Oregon Department of Forestry does not satisfy this requirement, and non-covered sites go through Type II review.
