Under Ark. Code Ann. 20-7-201 et seq. and the Arkansas Rules and Regulations Pertaining to Retail Food Establishments (which adopt the FDA Food Code), all mobile food units must obtain a permit from the Arkansas Department of Health (ADH) before operating. Operators must submit plan review applications, identify an approved commissary or servicing area, and pass inspections. Permits are not transferable. Cities may add business licensing and zoning rules, but they cannot waive ADH health requirements. ADH inspects mobile units at least annually and on complaint.
Operating without a permit can result in immediate closure, fines, and embargo of food. Repeat violations may trigger permit revocation and misdemeanor charges.
