Full Breakdown
425, Personal Property Sales, sets a flat numeric limit rather than a permitting scheme: no more than four sales may be held at any one residence during any calendar year, and each sale is limited to the daylight hours of two days within the same week, so a homeowner cannot stretch a single sale into a multi-day, all-hours event. 480, meaning oversized or illuminated sale signs still fall under the county's regular sign code. Subsection (C) carves out four categories that fall outside the four-sale count entirely: sales conducted under a court order or process, sales carried out by public officials in their official duties, sales run by a merchant or business from a properly zoned commercial premises rather than a home, and sales by a charitable, educational, cultural, or governmental organization where the proceeds go directly to that organization's purpose and the goods are not sold on a consignment basis.
That last exemption means a church or nonprofit rummage sale on qualifying property does not count against, or get counted toward, a homeowner's own four-sale annual limit, even if held on the same block.
Violations & Fines
A fifth sale in a calendar year, a sale that runs longer than two days or outside daylight hours, or sale signage that violates the temporary sign rules is treated as a zoning violation under Section 405.645: the Director of the Division of Planning and Zoning can order the activity stopped in writing. Continuing after that order is a misdemeanor under Section 405.655, with a fine of up to five hundred dollars per day or up to six months in the County Jail, and each day of continued violation counted as a separate offense.
