HOA architectural review committees (ARCs) derive authority from the recorded covenants. FL 720.3035 bars HOAs from arbitrary denials and requires written decisions within a reasonable time, typically 30 to 60 days.
Most St. Petersburg HOAs require Architectural Review Committee (ARC) approval before exterior modifications including paint colors, roofing, fencing, landscaping changes, solar panels, pools, and additions. Under FL Statute 720.3035, an HOA may only enforce architectural standards explicitly set forth in recorded declarations or rules. The ARC must apply standards consistently and cannot arbitrarily deny requests. Written decisions are required. If the ARC fails to respond within the time specified in governing documents, approval may be deemed automatic depending on the declaration language. FL 163.04 preempts HOA bans on solar collectors, though reasonable aesthetic restrictions on placement are allowed. FL 720.304 protects residents from bans on display of the US flag, yard signs for political candidates during election periods, and certain other protected displays.
ARC violations: fines up to 100 dollars per day capped at 1,000 dollars (FL 720.305). Unapproved modifications can trigger forced removal via lawsuit.
