Florida Statute 791.08 and 791.012 govern fireworks across the state and preempt most local bans, but municipalities may impose more stringent rules. Section 791.08 allows the use of fireworks solely and exclusively on designated holidays: Independence Day, New Year's Eve, and New Year's Day. Outside those days, only state-approved sparklers, snakes, and certain novelties listed in 791.01 may be used. Public displays require a permit from the city Fire Marshal under Chapter 13 Article II and must comply with NFPA 1123. Fireworks are prohibited in city parks unless authorized by a permit.
Illegal use of fireworks is a misdemeanor under Florida law and can also draw municipal nuisance citations and civil fines.
