Florida Statute 791.001 declares that Chapter 791 shall be applied uniformly throughout the state, preempting most local fireworks rules. Under FS 791.08, consumer fireworks may be used on July 4, December 31, and January 1 without violating the state ban on aerial and explosive devices. State Fire Marshal-approved sparklers, fountains, and snakes remain legal year-round. Pinellas Park residents must still follow noise rules, avoid causing fires or property damage, and use products only as the manufacturer intended. HOAs and condo associations may prohibit fireworks on private property. Sale is restricted to licensed retailers, and discharge near gas stations or flammable storage remains prohibited under fire code.
Discharging non-sparkler fireworks outside the three permitted holidays can lead to misdemeanor charges, fire code citations, and civil liability for damage.
