Summary

Marion County's code enforcement board only hears county ordinance violations, not private HOA deed restrictions or CC&Rs.

These county ordinances apply to unincorporated areas of Marion County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

The code enforcement board and special magistrates shall have the jurisdiction to hear and decide alleged violations of any county ordinance, including amendments that may be enacted.

(b) The jurisdiction of the code enforcement board and special magistrates shall not be exclusive. Any alleged violation of any of the aforesaid county ordinances may be pursued by appropriate remedy in court at the option of the administrative official whose responsibility it is to enforce that respective ordinance.

(c) The special magistrate shall not hear any case in which he or she has a conflict of interest through familial relationship, personal or business financial interest, or other conflict of interest recognized under the rules regulating the Florida Bar, or any case which would meet the standards of a voting conflict under F.S. § 112.3143.

Full Breakdown

Sec. 2-204 limits the Marion County Code Enforcement Board and special magistrates to hearing alleged violations of county ordinances. Private HOA covenants, conditions, and restrictions (CC&Rs) aren't county ordinances, so the county's code inspectors, board, and magistrates have no jurisdiction over them. A homeowner fighting an HOA over fence color, parking, or landscaping has to use the association's own enforcement process or go to civil court: calling county code enforcement won't get a CC&R violation cited or fined.

Violations & Fines

Not applicable: county has no jurisdiction to fine or cite CC&R violations; disputes go through HOA process or civil court.

Frequently Asked Questions

No. The county board and special magistrates only have jurisdiction over county ordinance violations, not private HOA covenants.
How do I enforce my HOA's CC&Rs then?
Through the HOA's own enforcement process (fines, hearings) or by filing a civil lawsuit against the violating owner.
