Ohio's statewide cottage food law lets you make non-hazardous foods like baked goods, jams, jellies, and candy at home with no license, registration, or inspection. Products must be labeled 'This Product is Home Produced' and sold within Ohio.
Cottage food is governed statewide by the Ohio Department of Agriculture under Ohio Revised Code Chapter 3715, not by Stark County. A cottage food production operation makes non-potentially-hazardous items, such as bakery products, jams, jellies, candy, and fruit butter, in the person's home without a license, fee, or inspection. Foods requiring refrigeration, acidified or low-acid canned foods, and other potentially hazardous items are not allowed. Every package must carry the statement 'This Product is Home Produced' in at least 10-point type along with the producer's name, address, and ingredients. Local zoning (your city or township) may still limit selling from the home, so check home-occupation rules.
Selling non-approved (potentially hazardous) foods, or mislabeling, can prompt Ohio Department of Agriculture enforcement and embargo of the product.
