Brownsville, TX Home Business: Cottage Food Operations (2026)

A cottage food production operation works out of the operator's home and sells directly to consumers. Since September 1, 2025 the annual gross income ceiling is $150,000, and permitted products cover any food except meat and poultry, seafood, ice products, low-acid canned goods, cannabidiol and THC products, and raw milk. Labels must carry the operation name and address or registration number, the product name, allergen disclosure, and the statement that the product was produced in a private residence not subject to governmental licensing or inspection. Time and temperature control foods require DSHS registration and safe handling instructions. Local health departments cannot inspect these kitchens. Brownsville's UDC still governs the home occupation itself.
