The Irvine Zoning Ordinance Chapter 2-18 establishes a cottage food operator permit process. Class A cottage food operations sell directly to consumers and require OC Health Care Agency registration plus a city permit. Class B operations may sell through third-party retailers and require an OC Health Care Agency permit. Both classes are limited to non-potentially-hazardous foods including baked goods, jams, granola, dried fruits, and candy. Annual gross sales are capped at $75,000 under state law. Operations must be conducted entirely within the home kitchen. A city business license is also required.
Operating without required permits is subject to enforcement by OC Health Care Agency and city code enforcement. Selling unapproved foods may result in permit revocation.
